Similarly to Bet (five years), the contract proposed by Bet (post mortem) establishes the sale of a painting that does not yet exist, to be delivered only after the artist’s death. By introducing, therefore, an indeterminate factor — the artist’s lifespan — something entirely different emerges: the contract acquires an almost absurd dimension, in which the implicit morbidity is punctuated by humor. Following the same logic of creating the very conditions of the speculative scenario, the price projections in this contract are based on comparative models drawn from the market values of historical artists. Also referencing a historical precedent within conceptual art and its critical engagement with the circulation of artworks and the legal framework surrounding them, the continuity clause borrows the structure of the contract written by Seth Siegelaub in The Artist’s Reserved Rights: Transfer and Sale Agreement (1971).
